Terms of Service “Giveaway”

OFFICIAL RULES

$5,000 Privacy Wall Giveaway

Sponsored by The Plant Stand of Arizona

1. Sponsor

This promotion is sponsored by The Plant Stand of Arizona (“Sponsor”), in partnership with All Terrain Landscape (“Installation Partner”).

This giveaway is not sponsored, endorsed, administered by, or associated with Instagram, Facebook, or Meta.

2. Promotion Period

The $5,000 Privacy Wall Giveaway begins at 12:00 AM MST on March 1 and ends at 11:59 PM MST on March 31 (“Promotion Period”).

Entries submitted outside of the Promotion Period will not be eligible.

Winner will be selected and announced on or about April 1.

3. Eligibility

To be eligible:

• Must be 18 years of age or older at time of entry 
• Must be a legal resident of Arizona 
• Property must be located within the approved Phoenix metro service radius 
• Must own the property where installation will occur 
• Property must have an existing irrigation system compatible with drip line connection 

Employees, contractors, or immediate family members of Sponsor or Installation Partner are not eligible.

4. How to Enter

To enter:

1. Submit entry via the official giveaway landing page 
2. Provide accurate contact information (name, email, zip code) 
3. Complete required social media actions (as outlined in campaign instructions) 

Limit one primary entry per person. Additional bonus entries may be offered through promotional actions but do not guarantee winning.

Incomplete or fraudulent entries will be disqualified.

5. Prize Description

One (1) winner will receive:

• Fifteen (15) Ficus Nitida trees 
• Soil amendments and staking materials 
• Delivery within service area 
• One-day promotional installation by All Terrain Landscape 

Total approximate retail value: $5,000
(Plant material valued at $1,500; installation valued at $3,500)

Prize is non-transferable, non-exchangeable, and has no cash value.

No substitutions except at Sponsor’s discretion.

6. Installation Scope & Limitations

Installation is provided as part of a promotional collaboration and is limited to:

• One (1) day installation 
• Connection of plant material to existing irrigation system via drip lines only 
• Maximum 10-foot drip line extension per plant location 
• No new irrigation zones, valves, timers, mainline modifications, system redesign, or pressure regulation included 
• No hardscape, grading, drainage correction, or soil remediation included 

If the property requires additional work outside the promotional scope, such work will not be included and may require a separate paid agreement.

7. No Warranty / As-Is Installation

Installation services are provided “as-is.”

Sponsor and Installation Partner make no warranties, express or implied, regarding:

• Plant survivability 
• Irrigation performance 
• Soil conditions 
• Weather impact 
• Workmanship longevity 

Once installation is complete, the winner assumes full responsibility for:

• Irrigation 
• Watering schedule 
• Fertilization 
• Maintenance 
• Pruning 
• Pest control 
• Ongoing plant care 

Sponsor and Installation Partner are not responsible for plant failure due to improper irrigation, neglect, environmental factors, pests, acts of God, theft, vandalism, or unforeseen site conditions.

8. Site Conditions

Winner must:

• Clear the installation area of debris and obstructions 
• Ensure safe access for installation crew 
• Disclose known underground utilities or hazards 

Sponsor and Installation Partner are not responsible for concealed underground conditions including but not limited to rock, clay, irrigation lines, electrical lines, gas lines, septic systems, or other buried obstructions.

9. Winner Selection & Notification

Winner will be selected at random from all eligible entries.

Winner will be notified via email (and phone if provided).

If the winner does not respond within 72 hours, Sponsor reserves the right to select an alternate winner.

10. Media Release

By accepting the prize, winner grants Sponsor and Installation Partner permission to:

• Photograph and video the property 
• Capture installation footage 
• Use before/after imagery 
• Publish content on websites, social media, advertising, and marketing materials 

No financial compensation will be provided for media usage.

11. Limitation of Liability

By entering, participants agree to release and hold harmless:

• The Plant Stand of Arizona 
• All Terrain Landscape 
• Their employees, contractors, agents, and affiliates 

From any and all claims, damages, losses, injuries, or liabilities arising out of participation in the promotion or acceptance/use of the prize.

12. Disqualification

Sponsor reserves the right to disqualify any participant who:

• Violates official rules 
• Provides false information 
• Attempts to manipulate the giveaway 
• Engages in fraudulent or abusive behavior 

Sponsor reserves the right to modify, suspend, or cancel the promotion if circumstances arise outside its control.

13. Privacy

Information collected through entry will be used for:

• Giveaway administration 
• Email marketing communications 
• Landscape-related promotions 

Participants may unsubscribe from marketing communications at any time.

Personal information will not be sold.

14. General Conditions

Sponsor reserves the right to:

• Substitute plant material with comparable inventory if necessary 
• Adjust installation scheduling based on weather or operational needs 
• Modify giveaway mechanics if required for legal compliance 

All decisions made by Sponsor are final.
